Facts
Robert Herman was a guest at a bachelor party for Thomas Hauck, which was held on a barge. John and James Hauck were also guests at the party. Some of the guests went skinny dipping, and others began throwing other guests into the water. At least two people threw Herman into the water against his will, and he was injured. Herman (plaintiff) sued Thomas, John, and James Hauck, the owners of the barge, and others (plaintiffs), alleging concerted action by all of the defendants. The lower court granted summary judgment in favor of John and James Hauck, and Herman appealed.
