Hoverson v. Hoverson
North Dakota Supreme Court
828 N.W.2d 510 (2013)
- Written by Mary Katherine Cunningham, JD
Facts
Sandra Hoverson (defendant) and Carl Hoverson (plaintiff) married in May 2004, and the couple had one son in 2005. When the couple married, Sandra quit her job as a radiologic technician, which had paid her a salary of $57,000 per year. Throughout the marriage, Carl managed and maintained a business, the Hoverson Farms LLP, as an equal partnership. Carl’s income from his farming ventures was substantial and subsequently valued as $1,635,307 per year. During the marriage, Sandra maintained a residence in Florida, and Carl maintained a residence in North Dakota. In August 2010, Carl sued Sandra for divorce. In December 2011, the trial court valued the marital estate at $14.5 million. The trial court then entered a divorce decree with 20 percent awarded to Sandra and 80 percent awarded to Carl. The trial court also ordered Carl to pay $3,000 per month in spousal support for two years and to pay $3,002 per month for child support. Sandra appealed, and Carl cross-appealed the divorce agreement entered in December 2011.
