Facts
After a flood washed out a power line, Twin State Gas & Electric Co. (defendant) ran a temporary replacement across a wooded lot, with the landowner’s permission. The line sagged so it touched and electrified a barbed wire fence. Humphrey (plaintiff) was hunting on the lot when he came into contact with the fence, suffering injury, and sued the electric company as a result. The trial court granted a directed verdict for the electric company, and Humphrey appealed.
