Facts
Husband W. (plaintiff) filed a petition against Wife W. (defendant), seeking a divorce on grounds of incompatibility. Not only did Wife W. put lye in Husband W.’s food, but she also tried to stab Husband W. with an ice pick. In turn, Husband W. locked Wife W. out of the house on a cold winter day, hit her over the head with a chair to the point of hospitalization on more than one occasion, threatened her with a piece of iron, and said that he would burn down the marital home. However, the trial court held that Husband W. had failed to prove that the marriage was irretrievably broken without possibility of reconciliation. Husband W. appealed.
