Facts
Hutchinson (plaintiff) ran in West Virginia's 1980 general election for United States Representative. Reese (plaintiff) ran in the 1980 election for a county-commissioner position. Both candidates experienced overwhelming defeats at the polls. Hutchinson and Reese filed suit in 1983 for damages. This suit rested on the allegation that a conspiracy rigged the 1980 election against Hutchinson and Reese. From this, Hutchinson and Reese alleged their entitlement to damages. Election irregularities alleged included the record of the opening of a box after the printing of a ballot tabulation. The United States Court of Appeals for the Fourth Circuit heard this appeal in 1986, six years after the election concluded.
