Facts
Richard Sorrels (plaintiff), who was 66 years old, filed a petition to adopt James Swanson, a 51-year-old adult who had been Sorrels’s companion for 17 years. The purpose of the adoption was twofold: (1) to formalize Sorrels and Swanson’s close emotional relationship and (2) to facilitate Sorrels’s and Swanson’s estate planning. The family court denied the petition, holding that a preexisting parent-child relationship was required in order for one adult to adopt another. Sorrels appealed.
