Facts
The Florida Constitution required the Florida Supreme Court to establish uniform criteria for determining the need for additional judges throughout the state. If the supreme court found a need for increasing or decreasing the number of judges, the supreme court was required to certify that finding to the state legislature. The state legislature could then either reject or accept the supreme court’s recommendation and provide funding accordingly.
