Facts
Frank Shine and Diana Shine, decedents, both died. Bobbye Shine (plaintiff) presented evidence that Diana predeceased Frank. John Gray (defendant) presented medical testimony indicating it could not be conclusively determined whether Frank and Diana died simultaneously or whether one predeceased the other. The trial court ruled that Frank and Diana had died simultaneously because there was insufficient evidence to the contrary. Bobbye appealed.
