Facts
Alvin Green (defendant) and Brenda Green (plaintiff) were married. Upon their divorce, Alvin and Brenda came to a voluntary agreement for Alvin to pay Brenda $1,950 for several months. The divorce court’s final divorce decree found that Alvin would make those spousal-maintenance payments in order to reach a fair division of the community estate. Alvin subsequently stopped making the payments, and Brenda filed a motion to enforce the divorce decree and have Alvin jailed for contempt of court. The district court granted the motion and placed Alvin in jail for contempt until he paid $32,384.92 to Brenda. Alvin filed a writ for habeas corpus with the Texas Supreme Court. The court granted Alvin release on bond pending review of the petition.
