Yolanda (defendant) was the mother of four minor children. The State of Nebraska (plaintiff) filed a motion to terminate Yolanda's parental rights based on neglect. Yolanda received notice, meaning that she was made aware of legal proceedings that affected her in some way. The court held a full evidentiary hearing. The evidence showed that Yolanda had been given opportunities to reunify with her three oldest children and rehabilitate herself. However, the attempts were unsuccessful. The court found that Yolanda's parental rights should be terminated as to all four children. Yolanda appealed the court's findings as to her youngest child. Yolanda alleged that it was unconstitutional for her parental rights to be terminated based upon a finding that she had previously neglected the three oldest siblings.
