2013 WL 653091 (2013)

Facts
Majestic Holdco, LLC (Majestic) (defendant) filed for Chapter 11 bankruptcy. Entergy Mississippi, Inc. (Entergy) (plaintiff) had provided power to Majestic’s casino and received notice of Majestic’s filing and relevant bar dates for making a creditor claim. For nine years, Entergy had been monitoring Majestic’s energy use with a meter it had installed. Three years after Majestic’s bankruptcy filing, Entergy discovered that the meter was defective and that it had underbilled Majestic over $1 million. Entergy moved for an enlargement of time so it could file its claims because the bar date had passed. These claims included $218,607.39 in administrative payments. Entergy filed additional claims 20 months after the applicable ear date. There was no indication that Energy’s actions were the result of bad faith.
