California Court of Appeal

Facts
After a judgment of dissolution of marriage, during a trial on reserved issues, the husband’s attorney, in anticipation of the court rejecting its valuation of the husband’s medical practice, made an oral request for a statement of decision showing the court’s calculation pursuant to California Code of Civil Procedure § 632. The trial court responded to the request indicating that if such was desired, counsel could make the request in writing. The trial court’s final order accepting the wife’s valuation of the medical practice did not include a statement of decision. The husband appealed.
