Facts
Roger Garrett (defendant) and Veronica Garrett (plaintiff) were married and subsequently divorced. Roger was an attorney with two contingency-fee cases. At divorce, the trial court determined that as to the first contingency contract, Roger did all the work for the contract during marriage. As to the second contract, which Roger worked on only after the marriage, the trial court held that if Roger had diligently applied himself, he would have completed all the work for the contract during marriage. The trial court therefore held that the fees earned from both contingency contracts were earned during marriage and subject to equitable division as community assets. Roger appealed.
