Facts
William David Kimbrell and Janet Bouley divorced in 1996. They agreed to share custody of their three children. Kimbrell later developed a fear that Bouley was intentionally alienating the children from him. Kimbrell and Bouley agreed to participate in psychological evaluations as part of their split-parenting arrangement. The court appointed a case manager and then a psychologist, both of whom concluded that any alienation of the children from Kimbrell was a result of Kimbrell’s own psychological problems. By 2004, only one of the children, Evan, was still a minor. The trial court ordered that contact between Kimbrell and Evan be arranged only according to Evan’s wishes. This resulted in a complete end to contact between Kimbrell and Evan. Kimbrell appealed. The Kansas Court of Appeals granted certiorari.
