Facts
On November 19, 2004, the United States Bankruptcy Court for the District of Oregon authorized the appointment of a future claims representative tasked with representing the interest of child-abuse victims whose claims arose out of the prepetition conduct of the Roman Catholic Archbishop of Portland (RCAP) (debtor). The RCAP contended that the future claims representative should represent only the interests of minors and victims suffering from repressed memory. The tort-claimants committee averred that the class should include those with memory but incapable of discovering resultant harm despite exercising reasonable care. The court determined the scope of the class of RCAP victims subject to future claims representation.
