Facts
Weekley Homes, L.P. (Weekley) (defendant) was initially the relator, and subsequently a defendant, in state-court litigation between HFG Enclave Land Interests, Ltd. (HFG) (plaintiff) and a third party. The trial court granted HFG’s motion to compel Weekley to turn over its devices containing electronically stored information (ESI) to HFG’s forensic experts in order to have those devices imaged, copied, and searched for relevant deleted emails. Weekley appealed to the Texas Supreme Court.
