Facts
Stephen T.K. (plaintiff) lived with Roseanne M.A. and her child, Jacob. Stephen and Roseanne were not married, but Stephen filed a petition to adopt Jacob. In a separate case, G.M. (plaintiff) was in a lesbian relationship with P.I. G.M. lived with P.I. and her child, Dana. G.M. filed a petition to adopt Dana. The trial court denied both petitions, finding that the proposed adoptive parents did not fall within New York’s adoption statute. G.M. and Stephen appealed to the Court of Appeals of New York.
