Facts
Eddie Irvine (plaintiff) was a prominent driver on the Formula 1 racing circuit. Talksport Ltd. (defendant) operated a radio station called Talksport, which had formerly been known as Talk Radio. As part of a promotional campaign, Talksport sent potential advertisers a promotional brochure with a cover photo of Irvine. The photo made it appear that Irvine was listening to a portable radio bearing the legend “Talk Radio.” Irvine brought an action for passing off on the basis that it was understood by the market that he had endorsed the station.
