Facts
Dr. Mervyn Isaacs (plaintiff) worked at Huntington Memorial Hospital (the hospital) (defendant). One evening Isaacs was shot in the chest in the hospital’s research parking lot that was across the street from the emergency room. Isaacs and his wife brought an action against the hospital for failing to provide adequate security measures to protect against the criminal acts of third persons on its premises. The trial court granted the hospital’s motion for nonsuit due to insufficient evidence. Isaacs appealed.
