Facts

Mohammed Ismail (defendant) and Zakya Ismail (plaintiff) were Egyptian citizens married in Egypt. They moved to Texas for six years to obtain Ph.D. degrees. While living in Texas, both spouses opened bank accounts, which were maintained during the length of the marriage. Both spouses moved back to Egypt and, while living in Egypt, purchased real estate in Texas. Mohammed returned to Texas for a research fellowship and later went back to Egypt. Zakya moved to Texas and filed for divorce. The trial court granted the divorce and distributed the Ismails’ community property, awarding property located in Egypt to Mohammed and the real estate located in Texas to Zakya. Mohammed appealed, arguing Texas could not apply community-property law if only one spouse currently lived in Texas and the property was purchased while the spouses lived in another jurisdiction.
