Facts
Martin Israel and Tammy Israel (plaintiffs) were siblings by adoption, but not by blood. Martin and Tammy sought to be married in Jefferson County, Colorado. Norman Allen (defendant), the county clerk and recorder, refused to grant them a marriage license. Martin and Tammy brought suit. The trial court ruled in favor of Martin and Tammy, holding that Colorado’s statutory prohibition of marriage between adopted brothers and sisters violated equal protection. Allen appealed. The Colorado Supreme Court granted certiorari.
