Facts
Barbara Izzarelli (plaintiff) sued R.J. Reynolds Tobacco Co. (R.J. Reynolds) (defendant), a cigarette manufacturer, under a theory of products liability. Izzarelli alleged that R.J. Reynolds included additives and manipulated the nicotine in its cigarettes in a manner that increased a user’s risk of cancer. During the litigation, the United States Court of Appeals for the Second Circuit certified a question to the Connecticut Supreme Court: whether the good tobacco exception to strict products liability contained in the Restatement (Second) of Torts precludes recovery for cigarette design-defect liability?
