Facts
Jasko (plaintiff) slipped and fell on a piece of pizza at a pizza counter in F.W. Woolworth Co.’s (Woolworth) (defendant) store, causing her injuries. Many customers at the store ate standing up and off of the wax paper upon which the pizza was served. Jasko brought a negligence suit against Woolworth. The trial court ruled in favor of Woolworth and the court of appeals affirmed. Jasko appealed.
