Facts
Jet Experts, LLC (plaintiff) entered into a contract with Asian Pacific Aviation Ltd. (Asian Pacific) (defendant) to purchase a 2012 Bombardier Challenger 300 Aircraft (Challenger 300). Dr. Gillis, the principal of Jet Experts, used aircrafts to perform organ-transplant services. Moreover, the characteristics of the Challenger 300 were well suited to Gillis’s particular purpose of organ transportation and ambulatory patient transport. These characteristics were not available in other aircrafts on the market. After finding a higher bidder for the Challenger 300, Asian Pacific terminated its contract with Jet Experts. Subsequently, Jet Experts filed suit against Asian Pacific, seeking specific performance of the contract. The district court took the matter under advisement.
