Facts
Jiaxing Zhonghua Chemical Co. (Jiaxing) (plaintiff), a major vanillin manufacturer, brought a trade-secret-infringement action against Wanglong Group Co., Ltd.; Ningbo Wanglong Technology Co., Ltd.; Xifu Kinglong Spice Co., Ltd.; Fu Xianggen; and Wang Guojun (collectively, Wanglong) (defendants). Wanglong refused to turn over its accounting books and other relevant information during the litigation. The Zhejiang Higher People’s Court found Wanglong liable for trade-secret infringement and, in lieu of Wanglong’s profits, used Jiaxing’s profits to calculate damages. The case was appealed to the China Supreme People’s Court.
