Facts
Clear Creek Independent School District (defendant), a public high school, passed a resolution permitting graduating seniors to choose student volunteers to deliver nonsectarian, nonproselytizing invocations at their graduation ceremonies. Jones sued for an injunction, arguing that Clear Creek’s resolution violated the United States Constitution’s Establishment Clause by injecting religion into public education. The district court ruled in Clear Creek’s favor, and Jones appealed.
