Facts
The widow and administratix of Jones’s estate (Jones) (plaintiff) filed a wrongful-death lawsuit against Hoffman (defendant), alleging that Hoffman’s negligence in operating a truck led to an automobile collision that caused the death of Jones. Jones requested that the jury be instructed to apply the doctrine of comparative negligence, as opposed to the doctrine of contributory negligence. The trial judge denied Jones’s request and instructed the jury to apply the doctrine of contributory negligence. The jury returned a verdict in favor of Hoffman. Jones appealed.
