Facts
A lease purported to grant the use of part of a basement in a building that had yet to be constructed. The lease also included covenants providing for the installation of heating and lighting in the basement. The building was constructed, but the basement lacked heating and lighting. The lessee (plaintiff) brought an action for specific performance. The lessor (defendant) demurred.
