Facts
Joseph (plaintiff) attended the University of Wisconsin. Joseph was a resident of Colorado and attended high school in Maryland. Joseph was charged the nonresident rate of tuition for each semester he attended the university. After completing his degree program, Joseph still owed the university $18,000 in unpaid tuition. The Board of Regents for the University of Wisconsin System (the board) (defendant) determines the tuition rates for the University of Wisconsin. Joseph filed a lawsuit against the board under 42 U.S.C. § 1983 alleging that the university’s tuition policy was unconstitutional. The trial court dismissed Joseph’s claims, ruling that the claims were barred by the Eleventh Amendment to the United States Constitution. Joseph appealed.
