Facts
Judge (plaintiff), a Black woman, was an assistant equal employment opportunity (EEO) officer in the Army. General Rogers considered Judge and two other candidates, Anita Gomez Troughton and Luther Santiful, for a job as EEO officer. Troughton and Santiful were both EEO officers, and Judge was an assistant EEO officer. On employee evaluations, Troughton and Santiful received Bs and higher, but Judge received five Cs. The review panel recommended that General Kroesen hire Troughton, who declined. The review panel reconvened but it did not recommend Judge. Judge sued for discrimination based on race and sex under Title VII of the Civil Rights Act of 1964 (Title VII).
