Facts
James Jurek (plaintiff) was married to Sharon Jurek (defendant). James and Sharon were separated and lived apart for four months before James filed for divorce. Two days after filing for divorce, James suffered an injury and lost his right hand and half of his right forearm. The trial court ruled that because James’s personal-injury claim arose while James and Sharon were still married, the personal-injury claim was community property. The court of appeals affirmed. James appealed.
