Facts
Ironworker Milton Kaneko (plaintiff) suffered injury when the steel girt on which he was standing gave way because it was not welded completely. Kaneko sued the manufacturer of the girt, Hilo Coast Processing (defendant) for negligence, breach of warranty, and strict products liability. The jury found for Kaneko, but the trial court reduced the award in proportion to Kaneko’s contributory negligence. On cross appeals, Hilo contested the strict liability finding, while Kaneko argued that contributory negligence does not operate as a defense to strict liability, meaning the court should not have reduced the award proportionally.
