Facts
Jack Kilgrow (plaintiff) and Christine Kilgrow (defendant) were married and had a seven-year-old daughter, Margaret. Jack and Christine held different religious beliefs. Margaret attended a school affiliated with Jack’s religion. Christine wanted Margaret to attend public school and threatened to prevent Jack from bringing Margaret to the religious school. Jack filed a petition for a temporary restraining order and a permanent order prohibiting Christine from interfering with Jack’s right to send Margaret to the religious school. Jack argued that such relief would be in the best interests of Margaret. The trial court granted Jack’s petition. Christine appealed.
