Facts
Switzerland (defendant) committed to reduce its greenhouse-gas emissions by 20 percent by 2020. When it failed to meet that target, Swiss nongovernment organization Verein KlimaSeniorinnen Schweiz (KlimaSeniorinnen) (plaintiff), meaning senior women for climate protection, filed a complaint against Switzerland in the European Court of Human Rights. The complaint alleged that Switzerland’s failure to meet its climate targets violated the European Convention on Human Rights, specifically Article 2’s right to life and Article 8’s right to respect for each person’s private life, family life, home, and correspondence. KlimaSeniorinnen argued that failure to adequately address climate change contributed to increasing heatwaves, which negatively impacted the life and health of senior women. When ruling on KlimaSeniorinnen’s claim, the court considered the intersection of climate change and human rights.
