Facts
Yulia Kohl (plaintiff) brought a negligence action against her ex-husband, Norman Kohl, (defendant) for giving her human papillomavirus (HPV). Yulia claimed that Norman should have known he had a sexually transmitted disease (STD) because he had high-risk sex including extramarital affairs and sex with prostitutes, and because his previous wife had undergone a hysterectomy. But no evidence linked his previous wife’s hysterectomy to HPV, showed that Norman had been diagnosed, or that he had any symptoms. The trial court dismissed Yulia’s complaint on the ground that it failed to state a cognizable claim. Yulia appealed.
