Kraisinger v. Kraisinger
Pennsylvania Superior Court
928 A.2d 333 (2007)
- Written by Sean Carroll, JD
Facts
Paul Kraisinger (defendant) and Angelique Kraisinger (plaintiff) were married with four children. Ms. Kraisinger did not have a job, but stayed home to raise the children. The couple divorced and entered into a separation agreement that required Mr. Kraisinger to pay $2,000 per month in child support. Ms. Kraisinger continued to stay home with the children after the divorce. Ms. Kraisinger filed a petition for increased child support. The trial court applied the nurturing parent doctrine to permit Ms. Kraisinger to stay home with the children until the youngest child was old enough to go to school. Mr. Kraisinger appealed, arguing that Ms. Kraisinger's income should be imputed when considering his child support obligations.
