Facts
Stan Kraly (plaintiff) and Susan Kraly (defendant) were a married couple. During the marriage, Stan purchased property near Lightning Creek Road (the Lighting Creek property) with the proceeds from the sale of his premarital home. Stan later filed for divorce. The magistrate court determined that the Lightning Creek property was community property. The district court reversed, finding that the Lightning Creek property was Stan’s separate property. Susan appealed to the Idaho Supreme Court.
