Facts
Kathleen Harney (plaintiff) married Joseph Kruzel. However, Kathleen continued using her maiden name, including in her employment as an art teacher. For insurance purposes, the school board insisted that Kathleen either adopt the Kruzel name or legally change her name from Kruzel to Harney. Kathleen petitioned the county circuit court to change her surname from Kruzel to Harney. The trial judge ruled that Kathleen must bear her husband’s surname. Kathleen appealed. The Wisconsin Supreme Court granted certiorari.
