L.M.E. v. A.R.S.
Michigan Court of Appeals
680 N.W.2d 902 (2004)
- Written by Meredith Hamilton Alley, JD
Facts
L.M.E. (plaintiff) was a married woman who was about 20 years old when she committed statutory rape against A.R.S. (defendant), a 14-year-old child. L.M.E. became pregnant, and the county prosecutor sought a child-support order against A.R.S. A.R.S. argued that because he was not old enough to consent to sexual activity, the intercourse was involuntary on his part and he should not be liable for child support. The trial court denied the prosecutor’s complaint to establish child support, and the county appealed.
