Facts
An automobile driven by Mr. Demares (defendant) struck and injured Mr. and Mrs. Charles (plaintiffs) while the Charleses were crossing the street. The injured pedestrians sued Demares and Demares’s insurer, La Mutualité Industrielle (defendant). The trial court ruled in favor of Mr. and Mrs. Charles but reduced the damages based on the Charleses’ contributory negligence. The parties appealed, and the appellate court placed fault entirely on Demares. Demares appealed.
