Laing v. Laing
Alaska Supreme Court
741 P.2d 649 (1987)

- Written by Sean Carroll, JD
Facts
Kenneth Laing and Marla Laing divorced. Kenneth had a non-vested pension at the time of the divorce. As part of the division of marital assets, the trial court treated Kenneth’s non-vested pension as marital property. The trial court awarded Kenneth the pension, based on its present value, and awarded Marla offsetting marital assets. Kenneth appealed, arguing that a non-vested pension is not marital property.
