Larson v. Larson
Illinois Appellate Court
42 Ill. App. 2d 467, 192 N.E.2d 594 (1963)
- Written by Eric Miller, JD
Facts
Two years after the marriage of Sidney Larson (plaintiff) to Myrtle Larson (defendant), Myrtle was committed to a mental institution. Later, Sidney sought annulment, asserting that Myrtle had been of unsound mind both before and after the marriage and, thus, not legally capable of entering into a valid marital contract. Sidney presented no proof of insanity predating the marriage. The court ruled against Sidney, who appealed. The Illinois Appellate Court granted certiorari.
