Leal v. Leal

Texas Court of Appeals
628 S.W.2d 168 (1982)

  • Written by Whitney Kamerzel , JD

Facts

Delia Leal (plaintiff) and Hector Leal (defendant) were married. Delia filed for a divorce. The trial court granted the divorce and divided the parties’ community property. Delia appealed, arguing the trial court failed to consider community-property money that Hector spent while the divorce was pending. Delia testified that Hector had a girlfriend on whom he spent community-property funds and argued that these amounts should have been taken into account by the trial court in dividing the community property. Hector testified that the community-property funds spent during the pending divorce were used for living and business expenses. Delia did not submit proof of the amounts Hector spent or what the funds were used for.
