Facts
Mrs. LeBlanc (defendant) and Mr. LeBlanc were married. The LeBlancs decided to separate, and they orally agreed to a division of their estate. The LeBlancs agreed that all community property given to Mrs. LeBlanc was under her sole management, control, and disposition. Soon after the separation, Mr. LeBlanc started a new business and became indebted to Peyton Waller (plaintiff). Mrs. LeBlanc was not aware of the debt and did not benefit from it. Waller sued Mrs. LeBlanc to recover the community property under her control to pay Mr. LeBlanc’s debt. The trial court held in Waller’s favor. Mrs. LeBlanc appealed.
