Facts
Levandoski (plaintiff), a town police officer, responded to a complaint about a noisy party, with the intention to end the party. While on the premises Levandoski saw Cone put some baggies in his pants, which Levandoski believed contained marijuana. Cone is not the owner of the premises. In an attempt to avoid arrest, Cone ran. While pursuing him, Levandoski fell off a ledge onto some rocks and was severely injured. The jury entered a verdict for Levandoski. The trial court denied Cone’s motion to set aside the verdict based on the firefighter’s rule. The matter was appealed directly to this court.
