Facts
French law prohibits the display of Nazi paraphernalia for sale. Yahoo! Inc. (Yahoo) (defendant) allowed visitors to its Yahoo.com site to view Nazi-related objects for sale through an auction service sponsored by Yahoo.com and through links to other sites. Although visitors to the Yahoo France (defendant) site, Yahoo.fr, were unable to see illegal images directly from that site, they could do so by following a link from Yahoo.fr to Yahoo.com. Two organizations whose purpose was to fight against the trivialization of Nazism, The Ligue Contre le Racisme et l’Antisemitisme (LICRA) and Etudiants Juifs de France (UEJF) (plaintiffs), sued Yahoo and Yahoo France in a French court, seeking damages and specific performance.
