Facts
An auto-repair garage operated by Highway Motor Company, dba Park Price Co. (defendant), stored Dale K. Low’s (plaintiff’s) car outside in an unfenced area while the engine was removed for repairs. Meanwhile, somebody stole the transmission. Low sued the garage for negligence and conversion. The garage introduced testimony about the current practices and customs of other garages in the area to prove that storing the car outside was not negligent. The trial court found the garage not negligent and Low appealed.
