Facts
Consuelo Martinez Madrigal (plaintiff) was the surviving spouse of Gregorio Madrigal. During Gregorio’s marriage to Consuelo, Gregorio obtained a life-insurance policy through his employment. Without Consuelo’s knowledge, Gregorio named his ex-wife, Concepcion Madrigal (defendant), as the beneficiary of the policy. Gregorio died, and there was a dispute concerning Concepcion’s right to the proceeds of the policy. The matter reached a trial court. The trial court awarded the proceeds to Concepcion, and Consuelo appealed, arguing, among other things, that the trial court should have placed the burden of proof on Concepcion to show that the gift of the proceeds to her was fair.
