Facts
Paula Malin married Brian Loynachan in 1999. Later in the marriage, Malin reviewed Loynachan’s credit-card statements from July 2002 through January 2005 and found about $12,500 in charges for lingerie, jewelry, and trips that were not for marital purposes. Malin filed for divorce in January of 2005. At trial, Loynachan admitted that he spent $9,000 on his relationship with his paramour. The trial court did not order Loynachan to reimburse the marital estate for the expenditures and divided the marital estate equally. Malin appealed, arguing that the trial court did not equitably divide the marital estate.
