Facts
Kathy Williams (plaintiff) and Claude Williams (defendant) married in 1984. Before the wedding, Kathy and Claude executed a prenuptial agreement that, in relevant part, waived each spouse’s right to spousal support upon divorce. The Williamses’ relationship became estranged in January 1986, and Claude moved out. Kathy filed for divorce and sought spousal support. Claude challenged the divorce petition, arguing that, pursuant to the prenuptial agreement, Kathy was not entitled to claim spousal support. The trial court ruled for Kathy and ordered Claude to pay spousal support, holding that the spousal-support waiver in the prenuptial agreement was per se void as contrary to public policy and that Kathy was unable to support her reasonable needs through appropriate employment. Claude appealed.
